1.- Background

These general conditions of online contracting (hereinafter, the general conditions of purchase) in conjunction with any other specific contractual agreements, if any, govern the relationship between Dermafrica (Pty) LTD (hereinafter, the entity) and third parties (hereinafter, the customers) who purchase the products offered on the website www.mesoestetic.co.za
The acquisition of the products offered on this digital channel entails the acceptance of these conditions, as well as the express, full and unreserved acceptance of all the conditions of use of the website and the general conditions of purchase published by Dermafrica (Pty) LTD, at the time the customer accesses the website. The customer may, at any time, access the general terms and conditions, print them or reproduce them from their computer or mobile device, easily, permanently and directly.
Orders can be placed in the languages in which the digital channel supporting the sale is available.
In the event that the customer agrees with the content of the general conditions of purchase, they must tick the box next to the following text:

Through the digital channel, Dermafrica (Pty) LTD markets its own products and services and, consequently, the existing contractual relationship between the customer and Dermafrica (Pty) LTD is limited to marketing and not to the provision of third-party services.

3.- The User


Access to browsing and use of the website confers the condition of user (hereinafter referred to as the user), and therefore, from the moment browsing the website begins, the user accepts all the Conditions established herein, as well as any subsequent modifications, without prejudice to the application of the corresponding legal regulations that must be complied with as the case may be. By purchasing any product, the user automatically adheres to these General Conditions.
The user declares that he/she is an entity with legal capacity, or a natural person of legal age (or an emancipated minor) and that he/she has the legal capacity to enter into contracts and execute these general conditions to purchase products offered through www.mesoestetic.co.za and that he/she understands these General Conditions in their entirety. The User must respect these General Conditions of Purchase.
The user expressly and unconditionally accepts that he/she is solely and exclusively responsible for his/her access and use of the mesoestetic RSA website.

5.- How to buy our products


The purchase process is carried out in the following way:

  1. Once the user accesses the website, to register, the customer can create a "username" and provide an "e-mail address" and a "password". The customer should provide truthful information about the data requested in the forms and accept the General Terms and Conditions. 
  2. The user must select the products they wish to purchase, adding them to their "shopping cart". Once the selection has been completed, if they want to continue with the transaction, they must click on "complete purchase".
  3. The user must provide the necessary data for the shipment: name and surname, company name, full address and telephone number. This data is stored in the database of Dermafrica (Pty) LTD and is only visible to authorised personnel of the Website.
  4. The user may enter discount coupon codes to obtain discounts, should they be available to them, on the final price of his/her shopping basket.
  5. Once the user has accepted the General Terms and Conditions and entered the delivery details, the user must make the payment.

6.- Price of the Services


The prices of the services are quoted in South African Rands (ZAR) and include VAT at the rate applicable at the time of the transaction.

Dermafrica (Pty) LTD is not responsible for exchange charges on foreign orders at the time of processing an order or a refund. This is the responsibility of your bank or credit card processing company. Dermafrica (Pty) LTD reserves the right at all times to unilaterally change the prices of the products on its website. In order to guarantee the user the certainty of the prices of the services, these will be the prices indicated in the advertising in force at the time of placing the order. Stock on offer is for a limited time and that pricing may change at any time without notice to you. Dermafrica will monitor stock levels and ensure that when stock is no longer available, the offers are discontinued. When such items are no longer available after you have placed an order, we will notify you and you will be entitled to a refund.
Prices do not include delivery costs. Delivery costs, unless they are offered free of charge, will be indicated at the end of the order, once the products to be purchased have been placed in the shopping cart and the delivery address has been provided.

  1. Conclusion of sales and availability of stock

 

Placing items in a shopping basket without completing the transaction does not constitute a completed order, and therefore, items may be removed from the shopping basket  if stock is no longer available or the price thereof might change without notice to you. You cannot hold Dermafrica liable if such items are not available or are not available at the particular price when you complete or attempt to complete the purchase cycle again at a later stage.

 

Items may not be purchased for resale. Should we suspect that any items are being purchased with intention to resell, we will notify you and have a right to cancel your order immediately.

 

 

8.- Data Protection


In accordance with current legislation, the personal data of users will be processed for the purpose of managing, in the broadest sense, the online purchase of products through www.mesoestetic.co.za, as well as the rights and obligations arising therefrom.
The personal data processed by Dermafrica (Pty) LTD will be those provided by the user when completing the customer registration required to make the purchase and all of those provided during the course of the same.
The personal data processed will be those provided at the time of customer registration or guest checkout and at the time of the online purchase.

10.- Loss, theft or larceny


Loss, theft or larceny of the product is the sole responsibility of the customer and Dermafrica (Pty) LTD is released of any liability in this context.

These Terms and Conditions of purchase shall be construed and governed in accordance with the laws of the Republic of South Africa.
These Terms & Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of South Africa.

  1. Liability Limitation and Indemnification

You are solely responsible for using the website and do so at your own risk. Our website sells skincare products, and using any purchased product is also at your own risk. By using these products, you and other users agree to indemnify us, our affiliates, and subsidiaries from any potential loss, injury, or damages.
